Two Tenants, One Notice

The High Court has confirmed the principle that where a lease for a dwelling is held by two tenants, either tenant can give a valid notice to terminate the tenancy.

The effect of such a notice is that both tenants will be required to vacate the premises at the expiry of the appropriate period.

An attempt to claim that this rule violated the human rights of the tenant who did not give notice – i.e. was a violation of their right to respect for private and family life – was rejected.
