Dead Cyclist's Family Awarded £337,500

The family of a cyclist who was killed in an accident involving a lorry has been awarded £337,500 in compensation at the High Court.

Ninian Donald, 33, who worked as a set builder, was in a designated cycle and bus lane when a tipper lorry turned across his path at traffic lights, dragging him under the wheels.

The lorry was signalling to turn left, but from his position Mr Donald could not see the indicators. The lorry driver did not see the cyclist because his mirrors were not properly adjusted and he failed to make doubly sure that there was nothing in the inside lane.

The judge approved a settlement on the basis that Mr Donald was 25 per cent to blame for the accident. Just before the collision, he had briefly mounted the pavement in order to avoid a bus that was stationary. Mr Donald’s family was awarded £337,500, which included a lump sum of £25,000 which is to be held in trust for his daughter, Rosie, until she is 18 years old.
